Healthcare Professional Media Guidelines, Consent & HIPAA Compliance

Introduction

Owner/Operator: Spyface Tech Company, LLC (d/b/a "ClinicBooking"), 30 N Gould St Ste N, Sheridan, WY 82801, USA.

These rules govern all photo/video ("Media") uploaded or authorized by healthcare professionals, clinics, hospitals, agencies, or their staff to ClinicBooking, including cross-platform imports, synced feeds, copy/paste uploads, and metadata edits. They apply globally and supplement local law.

Not medical advice. Media on ClinicBooking is informational, not diagnostic or prescriptive. Always direct clinical questions to a licensed provider.

Who May Upload

  • Licensed HCPs (MD/DO, DDS/DMD, APRN/PA/RN where allowed), clinics/hospitals, or authorized agency/photographer vendors acting for a verified practice.
  • Uploader must have actual authority to grant licenses and supply required releases (see Sections 3 and 8).
  • Accounts under investigation or with policy violations may be restricted from uploading.

Consent & HIPAA Authorizations

Before publishing any identifiable patient Media, you must possess and retain:

  • Written consent & HIPAA authorization (or local equivalent) allowing display on ClinicBooking and downstream channels (CDNs, search previews, social embeds), including before/after, video, voice, tattoos/scars.
  • Minor patients: consent of a parent/legal guardian; no nudity; verify ages and authority.
  • Retention: keep signed consents for at least the longer of 7 years or applicable law; produce upon our justified request.

De-identification option: If a patient withdraws consent, you must immediately notify us. We may remove or de-identify (e.g., blur, crop) where feasible.

Patient Identity & PHI Minimization

  • Remove direct identifiers (names, MRNs, DOBs, addresses, appointment screens, chart photos, EXIF GPS).
  • Use neutral backdrops; avoid reflected surfaces; no staff rosters/whiteboards in frame.
  • We may strip metadata (EXIF/GPS) and apply privacy watermarks or blurs for safety.

Before/After Standards (FTC)

  • Comparable conditions: same patient, angle, focal length, framing, lighting, distance, exposure, posture, makeup/hair, jewelry, and background where practicable.
  • Timing: disclose the post-op interval (e.g., "12 weeks post-op").
  • No outcome manipulation: never alter anatomy or skin texture to imply results. Cropping to protect privacy is permitted; do not hide adverse outcomes.
  • Disclosures: add "Individual results vary." Include material factors (e.g., adjunct therapies, BMI changes).
  • Claims substantiation: performance claims must be truthful, not misleading, and supported by competent and reliable evidence.

Authenticity & Editing Limits

  • Allowed: cropping for privacy/framing; minor exposure/white-balance corrections applied equally to before/after; removal of dust/sensor spots; faces/IDs blurred upon request.
  • Prohibited: skin/shape "beauty filters," AI upscaling that creates detail, body morphing, wrinkle/blemish smoothing, fake hairlines, teeth whitening for non-dental outcomes, background swaps suggesting a different setting.
  • AI/Generated Media must be labeled and may not depict clinical outcomes.

Minors & Sensitive Content

  • Minors: guardian consent; conservative framing; no nudity. Pediatric intimate-area content is prohibited.
  • Sensitive anatomy: restrict to clinical relevance; apply censoring where appropriate; avoid explicit imagery.
  • Graphic content: gore/surgical fields must be educational, respectful, and minimized; thumbnails must not be graphic.

Intellectual Property

By uploading or authorizing upload, you grant Spyface Tech Company, LLC (d/b/a "ClinicBooking") a non-exclusive, worldwide, perpetual, irrevocable (to the extent permitted by law), royalty-free, fully paid-up, transferable and sublicensable license to host, cache, index, transcode, reproduce, adapt, publish, translate, create derivative works (formatting/privacy edits), publicly display and perform the Media on and off the Platform.

You must own or hold valid licenses for all Media elements and rights of publicity for every person depicted. Provide ownership/licensing proof on demand.

File & Technical Standards

Disclosures & Advertising

  • Include "Individual results vary." Disclose material factors (adjunct treatments, weight change, retouching limits, lighting setup).
  • Paid relationships (brand/device/supplier) must be conspicuously disclosed and truthful; follow FTC Endorsement Guides.
  • No "typical" claims unless you possess competent and reliable evidence.

Prohibited Content

  • Deceptive, manipulated, or AI-fabricated outcomes; impersonation; doxxing; unconsented identifiers.
  • Illegal or unsafe activities; promotion of prescription drugs/devices contrary to law; off-label claims presented as approved indications.
  • Sexual content; explicit nudity; harassment; hate or discrimination.

Moderation & Review

We use layered moderation (automated + human). We may decline, de-rank, label, blur, or remove Media at our discretion for safety, legal, or quality reasons, without notice.

DMCA & Privacy Takedowns

Report alleged copyright infringement to: care@clinicbooking.com (subject: "DMCA"). Include: (1) work identified; (2) allegedly infringing URL; (3) good-faith statement; (4) accuracy/perjury statement; (5) your contact info; (6) physical/e-signature. For privacy/likeness complaints, explain the concern and provide verifying details. We may remove or geo-block contested Media while we assess.

Retention & Deletion

  • We maintain operational backups and logs. Removal requests will be actioned on a commercially reasonable basis across primary surfaces; caches and syndication may persist temporarily.
  • Uploader must retain patient consents/releases and production masters per Section 3.

Rights We Reserve

  • No duty to publish, monitor, or verify. We may request proof, annotate Media, or place safety labels.
  • We may cooperate with lawful requests by authorities and take measures to protect users and the public.

Enforcement & Penalties

  • Possible outcomes: warnings, removal, feature limits, temporary or permanent suspension, referral to regulators, and/or legal action.
  • Repeat or severe violations (e.g., non-consensual imagery, deceptive outcomes) may result in immediate account termination.

Appeals

If you believe we erred, email care@clinicbooking.com with URLs, context, and any consents/licenses. We will re-review at our discretion.

Policy Changes

We may update this Policy. Material changes will be signposted on this page. Continued use after changes means you accept the updated Policy.
