Purpose & Scope
ClinicBooking is a global marketplace where independent providers list services and patients discover, research, and connect. We do not practice medicine, give medical advice, or make referrals. Participation by professionals is a privilege, conditioned on compliance with this Policy, the Terms of Service, Privacy Policy, and Cookies Policy.
Core Eligibility
- Licensure. Active, good-standing license in each jurisdiction of service.
- Scope of practice. Activities must align with training, board/specialty recognition, and applicable law.
- Practice setting. Where required, operate through legally compliant entities (e.g., CPOM-compliant MSO/physician structures in the U.S.).
- Insurance. Maintain appropriate malpractice/ professional liability coverage where required.
- Truthful identity. Accurate legal name, credentials, affiliations; no impersonation or misrepresentation.

Critical Legal & Compliance Principles
- No medical advice; no referral service. We do not practice medicine or endorse providers or treatments. Listings are advertising/informational in nature.
- Anti-kickback & fee-splitting. No remuneration for referrals. Advertising fees must be flat and fair-value for marketing; no per-lead, per-appointment, per-case, percentage-of-fees, or outcome-contingent structures where prohibited.
- Corporate Practice of Medicine (CPOM). In U.S. CPOM states, non-physician controlled entities must not direct clinical judgment. Use compliant MSO/physician structures.
- HIPAA/PHI boundary. Do not upload Protected Health Information (PHI) to ClinicBooking systems except through designated, compliant channels and only where permitted by law and our agreements. We are not your medical record system.
- No duty to vet or monitor. We do not guarantee accuracy of listings, outcomes, or qualifications. We may—but are not obligated to—screen, verify, or remove content.
- FDA/FTC advertising rules. Claims must be truthful, non-misleading, and substantiated. Do not state “FDA-approved” where a device is only “cleared” for a different indication. No before/after deception.
- Scope and supervision. Non-physician clinicians must act within statutory scope with required supervision/collaboration agreements.
- CPD & training. Maintain training records for devices/procedures featured in your profile.
- Inducements. No gifts, discounts, or freebies tied to reviews, ratings, or patient steering.
- Patient safety first. Disclose material risks and typical recovery ranges in educational content; no guarantees of results.
- No duty to preserve PHI except as required by law. You are responsible for record retention; we may remove content consistent with policy and law.
Verification & Monitoring
- We may request proof of licensure, board status, privileges, insurance, or identity, and re-verify periodically.
- Automated and manual checks may review claims, photos, and outcome representations.
- Non-response to verification requests may result in suspension or removal.
Content Standards
- Educational, accurate, non-misleading, and compliant with regulator and advertising rules.
- Before/after images: same lighting/angles; disclose time to result; note adjunctive procedures.
- No hate, harassment, personal health disclosures without consent, or unsafe/self-harm content.
Reviews & Incentives
- No paid or incentivized reviews; no reviews by staff, family, or affiliated parties.
- Do not suppress or gatekeep negative reviews; you may respond professionally without PHI.
- We may moderate for authenticity, conflicts, and policy violations.
Telehealth & Cross-Border
- Follow telehealth laws (licensure, standard of care, e-prescribing, controlled substances).
- Cross-border listings must state the jurisdiction of care; disclose travel and follow-up limitations.
- No unlawful importation/advertising of drugs/devices.
Prohibited Practices
- Fee-splitting, referral payments, or lead bounties where prohibited.
- Unapproved claims, miracle cures, outcome guarantees.
- Use of unlicensed personnel beyond lawful scope; ghost surgery.
- Misuse of patient images or testimonials; AI-fabricated results.
Safety & Complaints
- We triage serious complaints (e.g., risk of harm) and may escalate to regulators/law enforcement.
- We are not an emergency channel. Patients should contact local emergency services for urgent issues.
Badges & Rankings
- Badges indicate disclosed criteria (e.g., verification date). They are not endorsements.
- Rankings/search results may consider relevance, completeness, recency, quality signals, and compliance.
Fees & Promotions
- Marketing fees are flat or subscription-based; not tied to procedures, revenue, or outcomes where prohibited.
- Promotions must be truthful, time-limited if stated, and honor advertised terms.
International Alignment
Where local healthcare/advertising law imposes stricter rules, those rules control. We may create country-specific requirements (e.g., UK GMC/GDC/GMC-ads, EU MDR, AUS AHPRA, CA CPSO/College rules).
Audits & Status Changes
- We may audit profiles for accuracy and compliance.
- You must promptly notify us of license restrictions, hospital privilege changes, or sanctions.
Enforcement & Appeals
- Actions may include warning, content removal, suspension, delisting, or reporting to authorities.
- Appeals: email care@clinicbooking.com within 14 days with supporting documentation. We may decline or uphold at our sole discretion.
IP & Platform Content
- You grant ClinicBooking a worldwide, non-exclusive, royalty-free license to host, display, distribute, and create derivatives of your submitted content for platform operation and marketing, subject to law and our policies.
- Do not upload content that infringes others’ rights.
Data Protection & PHI Boundary
- Follow applicable privacy laws (e.g., HIPAA, GDPR, UK GDPR, PIPEDA). Use secure channels only.
- ClinicBooking is not your medical record repository; do not store full patient charts on the platform.
Disclaimers & Relationship
- ClinicBooking is an advertising and information platform only—no medical advice, no endorsements, no referrals.
- No fiduciary, partnership, or joint venture is created by participation.
Modifications
We may update this Policy. Material changes will be signposted on this page. Continued participation after changes constitutes acceptance.
